These general conditions of sale (hereinafter, “General Conditions”) apply to all sales of products (hereinafter, “Products” or “Product”) purchased through the website www.apicolturaburato.it (hereinafter, “Site”).
\nUse of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter, “Customers” or the “Customer”), defined as natural persons acting for purposes outside their commercial, entrepreneurial, or professional activity.
\nThe language available for concluding the contract is Italian.
\nThe Customer is required to carefully read the General Conditions made available on the Site, in order to allow their storage and reproduction by the Customer pursuant to Article 12 of Legislative Decree No. 70 of April 9, 2003.
\nContracts concluded with Apicoltura Burato di Burato Paolo. (as defined below) through the Site are governed by Italian law and, in particular, by Legislative Decree No. 206 of September 6, 2005 (the “Consumer Code”) and Legislative Decree No. 70 of April 9, 2003 (hereinafter, the “E-commerce Decree”).<\/p>\n

Information regarding Products available for distance selling through the e-commerce Site, along with the relevant product codes, is available on the Site. This information is provided in accordance with Articles 52 and 53 of the Consumer Code.<\/p>\n
Product prices include all taxes and duties. All prices are expressed in euros. Shipping costs are the responsibility of the customer, except for any ongoing promotions.<\/p>\n
The essential characteristics and prices of the Products are listed in the offer for each Product.
\nTo purchase Products, the Customer must complete and submit the electronic order form to APICOLTURA BURATO, following the instructions on the Website. The Customer must place the Product in the appropriate “cart” and, after reviewing the General Terms and Conditions, with particular reference to the contribution to delivery costs and the methods of exercising the right of withdrawal, as well as the Privacy Policy, must select the desired payment method and choose the “Payment” option.
\nBefore submitting their purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure on the Website. In particular, the Customer has the right to modify the quantity of Products they intend to purchase, adding or removing one or more Products from the “cart”.
\nBy submitting the order, the Customer acknowledges and declares that they have read all the information provided during the purchase process and fully accept the General Terms and Conditions.
\nThe Customer will be able to view and track the status of their order through the “My Orders” area of \u200b\u200btheir account.
\nAPICOLTURA BURATO reserves the right to evaluate the acceptance of orders received. APICOLTURA BURATO will notify the Customer if it is unable to accept orders within 30 days from the day after the Customer placed the order with APICOLTURA BURATO and will refund any amounts already paid by the Customer for the supply.<\/p>\n
The Customer may pay for the Products and related delivery costs via PayPal, bank transfer, or cash on delivery.
\nThe transaction will be charged to the Customer’s credit card only after:
\na) the credit card details have been verified,
\nb) authorization has been received from the company issuing the credit card used by the Customer, and
\nc) availability of the Product has been confirmed by APICOLTURA BURATO.
\nAPICOLTURA BURATO also accepts payments made via bank transfer. Any bank charges will be borne by the Customer.
\nIf, for any reason, it is impossible to debit the amounts due from the Customer, the sales process will be automatically cancelled and the sale will be automatically cancelled.<\/p>\n
In accordance with the provisions of Article 53 of the Consumer Code, the Customer receives, upon execution of the contract, an email confirming receipt of the purchase order sent by the Customer. This email contains a summary of the General Terms and Conditions, the essential characteristics of the product ordered, its price, the amount paid, the right of withdrawal (with an indication of the time and method for returning the goods), the geographic address for submitting any complaints, and information on customer support services and existing commercial guarantees.<\/p>\n
No contract shall be deemed concluded between APICOLTURA BURATO and the Customer if APICOLTURA BURATO has reasonable grounds to believe that the Customer is not acting on the basis of a genuine interest in purchasing the ordered products, or is abusively exercising the right of withdrawal recognized in Article 12 below. In such cases, the order placed by the Customer shall be deemed void. APICOLTURA BURATO will send the Customer, via email, a notification confirming the failure to conclude the Contract, and will also cancel any charges and\/or expenses incurred by the Customer.<\/p>\n

Products purchased on the Site will be delivered to the address indicated by the Customer. The Customer may, in any case, request delivery of the products to a natural person of their choice, whose residence or domicile is within Italy. A signature of an adult over 18 years of age will be required upon delivery. Deliveries to PO boxes will not be made.
\nFor each order placed on the Site, APICOLTURA BURATO will issue an invoice for the shipped goods, sending it via email or post to the order holder, pursuant to Presidential Decree 445\/2000 and Legislative Decree 52\/2004. The invoice will be issued based on the information provided by the Customer at the time of ordering. No changes to the invoice will be possible after it has been issued.
\nDelivery costs are the responsibility of the Customer and are clearly indicated on the order form.
\nAll purchases will be delivered by an express courier chosen by the Customer during the purchase process from those offered by APICOLTURA BURATO (hereinafter, the “Courier”), Monday through Friday, excluding holidays and national holidays. APICOLTURA BURATO is not responsible for unforeseeable delays.
\nAPICOLTURA BURATO will send the Customer a confirmation email once the Products have been shipped. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within a maximum of 30 (thirty) days from the day after the Customer placed the order with APICOLTURA BURATO, unless APICOLTURA BURATO communicates\u2014within the same period, by email\u2014that it is unable to deliver the ordered goods due to the unavailability, even temporary, of the Products. In the event of such communication, APICOLTURA BURATO will refund any amounts already paid by the Customer for the supply. In the event that, following notification from APICOLTURA BURATO of a delay in the delivery date, the Customer wishes to cancel the Order, any amount already paid will be refunded as soon as possible, and in any case no later than 30 (thirty) days from the day after the Customer placed the order with APICOLTURA BURATO.
\nDelivery of the goods requires the presence of the Customer or a designated representative at the recipient’s address indicated in the order. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to that indicated on the transport document and that the package is intact and unaltered. Any damage to the package and\/or Products or discrepancies in the number of packages must be immediately reported by writing a reservation of inspection on the Courier’s proof of delivery. Once the Courier’s document has been signed, the Customer may not raise any objections regarding the external appearance or condition of the package delivered.<\/p>\n

Pursuant to the Consumer Code (Legislative Decree 206\/2005 and subsequent amendments), the consumer has the right to withdraw from the purchase contract concluded online without having to provide any reason, within 14 days of receiving the products.<\/p>\n
To exercise the right of withdrawal, the customer can use the dedicated electronic function available on the APICOLTURA BURATO website on the “Returns and Refunds” page, completing the dedicated form within the deadline established by current legislation.<\/p>\n
Once the request is received via the “Returns and Refunds” page, APICOLTURA BURATO will send an automatic confirmation of receipt to the email address provided by the customer and will provide the necessary instructions for returning the goods.<\/p>\n
The right of withdrawal is subject to the following conditions:<\/p>\n
The right of withdrawal applies to the product purchased in its entirety and cannot be exercised on only a portion of the purchased product.<\/p>\n
Return shipping costs are the responsibility of the customer, unless otherwise specified by APICOLTURA BURATO.
\nThe customer is responsible for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the products.
\nThe customer is responsible for shipping the returned goods until they are received at APICOLTURA BURATO’s warehouses.
\nAPICOLTURA BURATO is not responsible for any damage, theft, or loss of goods returned via uninsured shipments.
\nIn the event of damage to the product during return shipping, APICOLTURA BURATO will inform the customer so they can seek recourse against the designated courier.
\nTo obtain a refund, food products must be returned sealed, unopened, unconsumed, and in the same condition in which they were received. Products that are opened, partially consumed, altered, deteriorated, or otherwise no longer suitable for sale will not be accepted.<\/p>\n
For health and hygiene reasons and to protect consumer health, the right of withdrawal cannot be exercised on sealed food products that have been opened after delivery or are no longer suitable for resale.<\/p>\n
APICOLTURA BURATO reserves the right to inspect the condition of returned goods. If the product shows signs of opening, use, consumption, damage, alteration, or other conditions that prevent resale as new, the refund may be refused in cases permitted by applicable law.<\/p>\n
Once the returned goods have been received and inspected, APICOLTURA BURATO will refund the amounts due using the same payment method used by the customer for the initial transaction, unless otherwise agreed between the parties.<\/p>\n
APICOLTURA BURATO reserves the right to withhold the refund until the goods have been received or until the customer has provided proof of having returned the goods, whichever is earlier.<\/p>\n
The right of withdrawal may be excluded or limited in the cases provided for by art. 59 of the Consumer Code.<\/p>\n
In the event of returns of products that do not comply with the above conditions, APICOLTURA BURATO may return the goods to the customer, charging the customer the applicable shipping costs.<\/p>\n

APICOLTURA BURATO intends to offer Customers the option to exchange Products purchased through the Site.
\nTo obtain a Product replacement, please follow the procedure below.
\nCustomers who are not completely satisfied must retain all delivery documentation and the Product itself in its original packaging and immediately contact APICOLTURA BURATO by email at the following address: info@apicolturaburato.it
\nThe Product to be replaced must be received, in normal condition, at the following address: Via Masi, 8 Montecchia di Crosara 37030 (VR). Processing of the new order is subject to availability of the requested Products.
\nShipping costs for returning the Product are the responsibility of the Customer.
\nThe replacement Product will be sent to the Customer by courier without additional shipping costs.<\/p>\n
In the event of defects in Products sold by APICOLTURA BURATO through www.apicolturaburato.it, the Customer must immediately contact the Seller by email at info@apicolturaburato.it.
\nThe legal guarantees set forth in Articles 129, 130, and 132 of the Consumer Code apply to the sale of Products. The Customer has the right to have the goods restored to conformity, free of charge, through repair or replacement, or to an appropriate price reduction or termination of the contract. The Customer forfeits these rights if they fail to notify APICOLTURA BURATO of the defect within two months of discovering the defect. Any action to assert defects not fraudulently concealed by APICOLTURA BURATO expires, in any case, twenty-six months after delivery of the goods.<\/p>\n

The information regarding the Products provided on the Site is constantly updated. However, it cannot be guaranteed to be completely error-free.
\nAPICOLTURA BURATO reserves the right to correct errors, inaccuracies, or omissions, even after an order has been submitted, and to change or update information at any time without prior notice.<\/p>\n

These General Terms and Conditions are governed by Italian law and must be interpreted in accordance with Italian law.
\nAny disputes arising from the interpretation, validity, and\/or execution of these General Terms and Conditions shall be subject to the exclusive jurisdiction of the Court of Verona.<\/p>\n
